Terms of Service
These terms form a binding agreement between you (or the entity you represent) and BetDivision (Pty) Ltd, registration 2026/087518/07 ("BetDivision", "we"). By requesting credentials, calling the API, or using this website, you accept these terms.
1. The Service
BetDivision provides a hosted API and dashboard for managing affiliate partners, recording clicks and conversions, attributing revenue, calculating commissions and reporting analytics. The Service is a technical tool. It does not accept wagers, hold player funds, or provide gambling, financial, tax or legal advice.
2. Eligibility and accounts
You must be at least 18 years old and legally able to contract. You are responsible for the accuracy of your account details, for every action taken under your API keys, and for keeping those keys secret. Notify us immediately at manager@betdivision.co.za if you suspect compromise. We may suspend credentials that appear compromised or abused.
3. Acceptable use
- Comply with all applicable law, including gambling licensing conditions in every market you target, advertising standards, POPIA and consumer protection law.
- Do not market to, track, or accept traffic from minors or self-excluded persons.
- No incentivised, misleading, cloaked or trademark-bidding traffic; no cookie stuffing, forced clicks, iframe injection, typosquatting or malware.
- No attempt to reverse engineer, resell, sublicense, load-test without consent, scrape, or circumvent rate limits and authentication.
- Include responsible-gambling messaging where your licence or market requires it.
Breach of this clause is a material breach and may result in immediate termination without refund.
4. Fees
Fees, included request volumes and overage rates are set out in your order form or plan page. Charges are payable in advance unless agreed otherwise, are exclusive of VAT, and are non-refundable except where the law requires otherwise. Late amounts may attract interest at the prescribed statutory rate and may lead to suspension.
5. Data
You retain all rights in the data you submit. You grant us a limited licence to host, process and transmit it to provide the Service, to secure it, and to produce aggregated, de-identified statistics that never identify you or your partners. You warrant that you have a lawful basis for every record you send us and that your own privacy notices disclose the tracking you perform.
6. Availability
We target 99.9% monthly availability excluding scheduled maintenance and events outside our reasonable control. Any service credits are stated in your order form. Unless a written SLA applies, the Service is provided on an "as available" basis.
7. Intellectual property
The BetDivision name, logo, API design, documentation, dashboard and underlying software remain our exclusive property. Nothing here transfers ownership. You may use our marks only as needed to state that you integrate with BetDivision.
8. Warranties and liability
To the maximum extent permitted by law we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement. We are not liable for indirect, incidental, special, punitive or consequential loss, or for lost profits, revenue, goodwill or data. Our total aggregate liability is limited to the fees you paid us in the three months before the claim. Nothing limits liability for fraud, wilful misconduct, death or personal injury, or any liability that cannot lawfully be limited.
9. Indemnity
You will indemnify us against claims, penalties and reasonable legal costs arising from your use of the Service, your traffic sources, your marketing content, or your breach of these terms or of applicable gambling and data-protection law.
10. Suspension and termination
Either party may terminate for convenience on 30 days' written notice, or immediately for material breach that is not cured within 10 business days. On termination your access ends and we will make an export of your data available for 30 days before deletion.
11. Changes
We may amend these terms and will post the revised version here with a new date. Material changes take effect 14 days after posting; continued use is acceptance.
12. Governing law
These terms are governed by the laws of the Republic of South Africa, and the parties submit to the jurisdiction of the South African courts. The parties will attempt good-faith resolution before litigation.
